This report analyses a decade of data on strip searches and drug dog use in New South Wales, obtained through parliamentary Questions on Notice after initial access was denied. Between 2014 and 2023, NSW Police conducted 82,471 strip searches. Illicit substances were found in only 13.5% of cases, meaning 86.5% of searches yielded no drugs. The report calls for changes based on these findings.

The Employment Rights Legal Service thanks the Review Panel and the Department of Employment and Workplace Relations for the opportunity to provide a submission on the review of the operation of the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (‘Secure Jobs, Better Pay Act’) and the amendments made by Part 16A of Schedule 1 of the Fair Work Legislation Amendment (Closing Loopholes) Act 2023 (‘the Review’).

ERLS strongly supports legislative reform to limit the use of non-compete and other restraint of trade clauses, particularly in relation to low- and middle-income workers. Our key reform priority is to ban non-compete clauses in employment contracts in Australia, at a minimum for low- and middle-income workers. We also recommend further reform to restrict other restraint of trade clauses (such as non-solicitation clauses) in employment contracts so that they only operate to the extent that they are reasonable and proportionate.
