His wallet, which contained his Mozambican driver’s licence, was stolen.
Sebastian went to a Roads and Maritime Services registry to apply for a NSW licence. He was incorrectly issued with a NSW learner licence, despite being eligible for a full NSW licence. Sebastian was not informed of the conditions attached to a learner licence such as mandatory supervision and the display of ‘L’ plates.
A few days later, Sebastian was pulled over by police for a breath test. He showed them a photocopy of his overseas licence and his recently issued NSW learner licence. The police officer suspended his licence for not complying with the learner requirements. Sebastian then drove away and was immediately charged with driving whilst disqualified.
Sebastian was very confused by the situation because he held a current unrestricted licence. He came to RLC for help. RLC was able to assist him in his court preparation and research to show he was incorrectly issued with the learner licence. Sebastian successfully avoided the charges.
Sebastian’s situation demonstrates how easily international students can experience legal difficulties whilst trying to comply with NSW law. Language and cultural barriers mean that minor administrative issues can turn into far more serious legal problems and can end up in court.
