ERLS strongly supports legislative reform to limit the use of non-compete and other restraint of trade clauses, particularly in relation to low- and middle-income workers. Our key reform priority is to ban non-compete clauses in employment contracts in Australia, at a minimum for low- and middle-income workers. We also recommend further reform to restrict other restraint of trade clauses (such as non-solicitation clauses) in employment contracts so that they only operate to the extent that they are reasonable and proportionate.
