ERLS strongly supports legislative reform to limit the use of non-compete and other restraint of trade clauses, particularly in relation to low- and middle-income workers. Our key reform priority is to ban non-compete clauses in employment contracts in Australia, at a minimum for low- and middle-income workers. We also recommend further reform to restrict other restraint of trade clauses (such as non-solicitation clauses) in employment contracts so that they only operate to the extent that they are reasonable and proportionate.

This report outlines the achievements of the partnership between the three community legal centres and marks the release of an independent review of ERLS’s four-year impact.
