Ms King claims that Jetstar’s policy contravenes the Disability Discrimination Act, since she was denied access to a flight in 2008 on the basis that the flight already had two passengers needing wheelchair assistance.
As a result of a motor accident, Ms King, who is 75 years old has post –polio syndrome and a crushed vertebrae.
Ms King said she is not seeking financial compensation, rather is fighting this case to ensure Australian’s living with a disability are treated the same as everyone else.
"I deserve to be treated the same as any other Australian, not made to be felt like a second class citizen.” Ms King said.
“This fight is for all Australians living with a disability.”
Redfern Legal Centre chief executive Joanna Shulman said, Australia is the only country which limits the number of passengers with disabilities travelling on the same aircraft at the same time.
"People with Disabilities are entitled to enjoy equality of access to air travel, in order to ensure they are able to participate fully in society", Ms Shulman said.
Disability Discrimination Commissioner, Graeme Innes AM has raised serious concerns about Jetstar’s policy at a Senate Estimates Hearing last week and has requested for tougher regulation.
