Submission: Inquiry into domestic violence trends and issues in NSW

The use of electronic tracking devices to improve compliance with apprehended domestic violence orders (ADVOs) has little deterrent effect and the probable expense cannot be justified. Their use will not solve the failure to properly investigate domestic violence offences before the granting of an ADVO.

The RLC considers that existing penalties for domestic violence offenders are adequate. Nevertheless, we recommend increased resources for policing and prosecution of ADVOs, increased training for police, and a requirement that police record reasons for not proceeding with the prosecution of a reported breach.

The RLC further recommends that police be cautious in prosecuting women for domestic violence offences in case the complainant is the primary aggressor. Specialist domestic violence court lists should be implemented, with specialist judicial officers, prosecutors and police.
